Backdated Benefits

What is backdated benefit?

Backdated benefit is benefit paid to you for a period in the past when you were unable to claim because of certain personal circumstances.

How far back can backdated benefit be paid?

From 6 October 2008 the backdating rules changed.  Prior to this date, the length of time a claim could be backdated changed from a maximum period of 52 weeks from the date of written request, for all customers, to:

  • a maximum period of three months for people 'Pensioners' aged 60 years and over or

  • a maximum period of six months for 'working age' customers aged under 60 years old.

We count back from the date we receive a written request from you. If you wish to apply for backdated benefits, you will need to fully complete a Backdated Claim Form.

The form helps you to show "Good Cause" for the reasons why you were unable to make the claim for benefits during the backdated period.  You must show continuous "Good Cause" for the whole of the backdated period.  However, you may have more than one reason or cause for the "Good Cause".  These reasons should be consecutive, without any breaks in them.  You will need to provide the exact date that you wish your claim to be backdated to. 

You may wish to provide supporting evidence or proof to help with your application.  Please try to provide as much information as you can about your circumstances at the time.  Some details may appear obvious, but you need to provide a full and comprehensive application. 

When you have fully completed the form you will need to ensure the form is signed and dated before you return the completed form.

Can I get benefits from before I applied.  Can I get my claim backdated?

In certain circumstances, we may consider backdating your claim for Housing Benefit to a date before you made your claim. All requests for backdated Housing Benefit must be made in writing and you must have a good reason as to why you could not claim on time.

A claim may only be backdated for a maximum of 52 weeks prior to the claim for backdating being made.

How do I claim backdated benefit ?

You must apply to us in writing if you want your housing or council tax benefit backdated. You will need to complete a Backdated Claim Form.  Depending on what you tell us we may ask for supporting evidence. For example a letter from your doctor if you are/were ill.

Can I get my claim backdated? What do I need to show?

We can only backdate your benefit if you are able to show us continuing good reason why you did not claim the money at the time, so we will normally need official supporting evidence.  An example of this may be a letter from your doctor if you have been ill and were unable to put in an application. You will also need to provide proof of all you income and capital for the period you want to claim backdated benefit.
