Planning Enforcement

We may take enforcement action if:

•  you have started or completed a development without permission 

• the development does not meet with planning conditions

 Possible enforcement actions include:

•  asking you to apply retrospectively

• issuing enforcement notices

• issuing stop notices

• issuing County or High Court injunctions.

If land or buildings have been in use for a certain period of time without planning permission then a certificate of lawfulness may be applied for meaning the land or building becomes immune from enforcement action.

 The enforcement of planning control now enjoys a significantly higher profile than in the past with greater public expectations about what could and should be done.

 These higher expectations now demand that a more robust policy document is published which clearly identifies when and how prompt action can be undertaken.

 The Planning Enforcement Policy Statement has been adopted by the Council.

 This document gives clear guidance and direction as to when enforcement action can be successfully pursued and focuses resources to those more serious breaches of planning control.
