Smokefree

Local councils have been at the forefront of implementing smoke free law in England, the biggest public health change for fifty years. Our experience, from inspections and compliance-building work, has been that this is a popular law and is embraced by businesses and general public alike.
 
In the lead up to the 01 July 2007, when the smoke free legislation was introduced, Eastbourne Borough Council worked closely with businesses, employers and the public in order to educate and inform them of the changes using a variety of media. 
 
Many of the businesses visited by Council officers have used the introduction of the smoke free law as an opportunity to develop their services in other areas, for example by offering food and more family focussed environments.  Businesses are now enjoying the benefits of attracting new customers to cleaner, healthier, and smoke free premises.
 
Council officers continue to carry out inspections, based on risk and/or complaints, where possible combining these with other regulatory inspections such as food safety and health and safety to reduce burdens on businesses. This work has helped businesses fully understand the law and ensure their premises are smoke free, with inspections demonstrating very high levels of compliance. All smoke free activities have been funded by a Central Government grant of £42,000, which is still being used to support smoke free activities with partners, including East Sussex Downs and Weald NHS, as well as compliance and enforcement of the law.   
 
In the nine months from July 2007 to March 2008, the council have inspected over 1000 premises and vehicles and found over 99% to be complying with the regulations. Officers have issued 4 warning letters, but have not had reason to issue fixed penalty notices and/or instigate prosecution proceedings. The law has quickly become self-enforcing and Council Officers continue to visit premises to monitor compliance. In addition, Officers are on hand to offer advice and guidance to ensure compliance, with the Council’s website being visited regularly as a source of on line assistance.
 
A Council spokesperson said “Eastbourne Borough Council is delighted at the willingness of businesses and individuals to embrace the smoke free legislation.  This is reflected in the overall compliance levels that have been witnessed.  These levels have been achieved by partnership working, not only with the Council but also with Partner agencies to help support those wishing to stop smoking.”
