When implemented, the Gambling Act 2005 will mark a significant shift in the way in which we approach the licensing of premises for the purposes of gambling, the issue of gaming machine permits and the licensing of lotteries.
The Act will replace legislation which is over 25 years old and transfers responsibility for these matters from the Magistrates Courts to Eastbourne Borough Council. It also establishes a new regulator, the Gambling Commission, and it is anticipated that there will be close liaison between the Commission and Eastbourne Borough Council.
The Act requires the Local Authority to formulate a three year Gambling Statement, detailing how it will such manage matters. As part of the process, all Local Authorities are required to prepare, publish and then consult widely on their local statement of principles under the terms of the Act, framed around the following licensing objectives:
preventing gambling from being a source of crime or disorder, being associated with crime or disorder or being used to support crime
ensuring that gambling is conducted in a fair and open way and
protecting children and other vulnerable persons from being harmed or exploited by gambling.
Friday 9 June 2006 marks the start of the consultation process which will end on Friday 9 September 2006.
