A basic explanation of your Data Subject Rights under the Data Protection Act (1998), as detailed in Part II is set out below.
1. Right of access to Personal Data
You may request any Personal Data that the Council holds about you and the purpose(s) for which it is held.
We will provide the Personal Data as at the time of the request subject to any routine processing continuing between that time and the time of the Council’s response.
Your request will be replied to within 40 calendar days of receiving the request and fee, or, if later, on receipt of any supplementary information needed to establish your relationship with the Council or verify your identity.
2. Right to prevent processing likely to cause damage or distress
You are entitled, by notice in writing, to require the Council to cease (or not to begin) processing Personal Data if it is causing or is likely to cause you or another person substantial damage or distress and that damage or distress is or would be unwarranted.
This does not apply where you have agreed to the processing, the processing is necessary for compliance with a legal obligation, or the processing is necessary to protect your vital interests.
3. Right to prevent processing for the purpose of direct marketing
You are entitled, by notice in writing, to require the Council to stop using Personal Data about you for the purposes of direct marketing. Direct marketing means the communication (by whatever means) of any advertising or marketing material that is directed to you personally.
4. Rights in relation to automated decision-taking
You are entitled, by notice in writing, to ask the Council to make sure that no decision taken by or on behalf of the Council that significantly affects you, is based solely on the automated processing of your Personal Data.
5. Compensation for failure to comply with certain requirements
You are entitled to take action to seek compensation if you suffer damage by any contravention of the Data Protection Act (1998) by the Council.
6. Rectification, blocking, erasure and destruction
You are entitled to take action to rectify, block, erase or destroy inaccurate data you think the Council is holding.
7. Jurisdiction and procedure
This applies if you take legal action against the Council in order to obtain Personal Data about you that you think we are not giving you.
It mentions that even if the court rules in your favour you might not get the Personal Data you have asked for.
