The Data Protection Act (1998) advises that Subject Access Requests must be replied to within 40 calendar days from the date of receiving the request, payment and any additional information that may be required.
This time limit may be extended in exceptional circumstances if the request is very large or complex. If this is the case we will keep you fully informed of the progress of your request.
Every effort will be made to provide the information requested as quickly as possible; however, Eastbourne Borough Council holds a large amount of information which may result in some extra time being taken to find all of the information detailed. The Council would ask for your understanding in such circumstances.
In all cases once you have received the information you should check it to ensure that you have received all of the information to which you are entitled and to make sure it is correct.
If you feel that you have not received all of the information you asked for then you can either appeal to the Council through its internal complaints procedure, or complain directly to the Information Commissioner whose staff will look into the matter on your behalf.
