Pollution Enforcement Policy

Consultation was invited between 12 January 2007 and 12 March 2007 by submitting an online form or writing to the council's Health and Environment Team Manager.

About the Policy

The council's Pollution Enforcement Policy sets out the enforcement framework in which the Health and Environment Team will operate to achieve the aims of the Community Strategy.

To support the strategy theme for the Environment, the policy aims to facilitate local residents to:

  • enjoy a higher quality of life through having a clean, safe and accessible natural, urban and marine environment

  • value and protect the environment, conserving and enhancing it for future generations

  • ensure that all new developments are planned and designed with minimal adverse impact on either the historic or the natural environment.

The main types of legislation enforced by the Pollution Team are:

  • Public Health Acts 1936 and 1961

  • Prevention of damage by Pests Act 1949

  • Control of Pollution Act 1974

  • Local Government (Miscellaneous Provisions) Act 1976

  • Environmental Protection Act 1990 (includes air quality, statutory nuisance, contaminated land and dog welfare).

  • Environment Act 1990

  • Clean Neighbourhood and Environment Act 2005

Enforcement Concordat Good Practice

The Council has signed up to the Government’s 1998 Enforcement Concordat Principles of Good Enforcement. The Concordat sets out what business and others being regulated can expect from enforcement officers.
