Your questions answered about the Primary Authority Scheme
From 6 April 2009, businesses that operate across many Local Authority boundaries will have the right to request a partnership with a single Local Authority. This is known as the Primary Authority partnership scheme.
The scheme introduces provisions for businesses, charities or other organisations that operate across more than one site, to enter into a partnership agreement with a single authority for it to become that organisation's Primary Authority (PA).
PA gives business the confidence to expand and grow, knowing that the regulatory advice they receive is binding on other local Local Authorities. The costs associated with trying to comply with different Local Authorities interpretations of the law are reduced and businesses can benefit from the reduced regulatory burden conferred by inspection plans.
Who Can Have a Primary Authority?
Any business, charity or other organisation that is regulated by two or more Local Authorities in respect of a relevant function – typically matters such as Environmental Health or Licensing.
However, it is a voluntary scheme for business, so you can continue to work with separate authorities for each business site as at present.
How Does it Work?
As part of the partnership, the Primary Authority can work with its partner business to prepare a national Inspection Plan. This would give guidelines to other Local Authorities regarding the way the business ought to be inspected in order to minimise unnecessary checks.
Once an Inspection Plan has been published, a Local Authority must have regard to the plan when inspecting the business.
What are the Business Benefits for you?
-
Reduced regulatory burdens
-
Enhanced relationships with Local Authority officers
-
More comprehensive and accurate advice that is resistant to challenge Primary Authority will liaise with other Local Authoritys to ensure inspection and enforcement action reflects that advice.
How Much Does it Cost?
A fee may be charged for a PA agreement to cover our costs.
