This document sets out the council’s policy for health and safety enforcement and the procedure to be followed by the council's Health and Safety Enforcement Officers.
Health and safety at work is enforced by the council's Environmental Health service, working with the Health and Safety Executive (HSE).
Enforcement Guidance
Our Enforcement Policy is based on Health and Safety Commission (HSC) guidance and the principles of the Enforcement Concordat that has been adopted by the council.
Consideration is also given to the Enforcement Management Model which is a framework which helps enforcement officers make enforcement decisions in line with the Health and Safety Commission’s Enforcement Policy Statement.
It sets out principles that should be applied when determining what enforcement action should be taken in response to breaches of health and safety legislation.
Risk Management and Better Regulation
The principle of this model is that enforcement action should be proportional to the health and safety risks and the seriousness of the breach.
The council’s approach to enforcement reflects their responsibilities under the Health and Safety at Work Etc. Act 1974 and associated legislation in those premises for which we are the enforcing authority.
